These Terms govern your use of MindSell websites and landing pages, including mindsell.co.il and any hosted version operated by MindSell. A website inquiry or call does not create a client relationship. Any paid engagement begins only after MindSell LLC and the client agree to separate written service terms.
1. Acceptance of terms
By accessing or using this website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website.
2. Business audience
This website is intended for business owners and authorized representatives of home-improvement contractor businesses, including ADU, remodeling, roofing, and insulation companies. You must be at least 18 years old and authorized to provide information on behalf of the business you identify.
3. Website inquiries
Submitting a form authorizes us to review the information provided and contact you about potential fit. We may accept or decline an inquiry at our discretion. Service-area fit, qualification criteria, campaign scope, and launch timing are not final until confirmed in writing.
If you check an SMS consent box, you agree that MindSell may contact you about your inquiry by calls and text messages, including messages sent using automated technology. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Consent is not a condition of purchase. We do not sell, rent, share, or provide mobile phone numbers or messaging-consent data to third parties or affiliates for their marketing or promotional purposes. Service providers may process this data only as needed to deliver communications for MindSell.
Carriers are not liable for delayed or undelivered messages.
4. Separate service agreement
If we agree to work together, campaign responsibilities, media budget, appointment criteria, agency fees, billing, and cancellation will be documented in a separate written agreement. If that agreement conflicts with these website Terms, the signed agreement controls for the services it covers.
5. Advertising accounts and media spend
Unless otherwise agreed in writing, campaigns are managed in an advertising account owned or controlled by the client. Advertising-platform charges and media spend are paid by the client directly to the platform and are separate from MindSell's agency fee. The client remains responsible for account access, accurate billing information, platform policies, and lawful claims used in its advertising.
6. No guaranteed results
Marketing performance depends on many factors outside MindSell's control, including market demand, service area, competition, media budget, platform changes, seasonality, client capacity, sales performance, and homeowner behavior. We do not guarantee a specific number of leads, appointments, contracts, revenue, or return on advertising spend unless a specific commitment is included in a signed agreement.
7. Qualified meetings and exclusive leads
Unless a signed agreement states otherwise, MindSell earns its agency fee only after a qualified in-home meeting actually takes place. A qualified meeting requires all relevant decision-makers to be present, the homeowner to have expressed genuine intent to begin a project, and the project to meet the minimum scope agreed with the client before launch rather than being a minor repair or small service call. The final qualification criteria, including trade, service area, project scope, and attendance requirements, are agreed in writing before launch. A completed qualified meeting can be billable even if it does not result in an estimate, contract, sale, revenue, or profit. Leads generated for an active client campaign are handled for that client and are not resold to another contractor. This lead exclusivity does not reserve an entire city or territory.
8. Acceptable use
You may not misuse the website, attempt unauthorized access, interfere with its operation, submit false or unlawful information, copy substantial portions of the website, or use its content in a way that violates applicable law or another person's rights.
9. Intellectual property
The website's text, design, branding, graphics, processes, and other content are owned by MindSell LLC or used with permission. You may view the website for legitimate business evaluation but may not reproduce or exploit its content without written permission.
10. Third-party services
The website may rely on or link to third-party services. MindSell does not control their availability, security, policies, or content and is not responsible for losses caused by third-party systems outside our reasonable control.
11. Disclaimer and limitation of liability
The website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, MindSell disclaims implied warranties and will not be liable for indirect, incidental, special, consequential, or punitive damages arising from website use. MindSell's aggregate liability relating solely to the website will not exceed the amount you paid to access the website, which is normally zero.
12. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute relating solely to these Terms or the website will be brought in a court of competent jurisdiction located in Delaware, unless applicable law requires otherwise.
13. Changes
We may update these Terms from time to time. Continued use after an updated version is posted constitutes acceptance of the revised Terms.
